How the Supreme Court Decision Allows Mifepristone Mail Orders to Continue
The case is State of Louisiana v. US Food and Drug Administration. The Court's decision keeps the FDA's removal of in person dispensing requirements for mifepristone intact during ongoing litigation.
Louisiana and ADF had challenged the policy on behalf of the state and Rosalie Markezich, a Louisiana resident who alleged coercion into taking abortion drugs mailed from California.
The case now moves to the 5th Circuit Court of Appeals, where the 5th Circuit previously ruled the Biden FDA's mail order policy "arbitrary and capricious." Louisiana and ADF plan to argue that the FDA exceeded its statutory authority and failed to adequately consider safety risks. The legal fight is far from over.

The Supreme Court's emergency denial is a setback. It is not the end. Erin Hawley and ADF are right to keep fighting. The 5th Circuit already ruled that the Biden FDA acted unlawfully. The legal path forward is clear. Christians must keep the pressure on. Defund Planned Parenthood. Push state level restrictions on mail order pills. Demand a pro life FDA Commissioner. Dobbs returned the question to the states. The federal abortion drug pipeline must not be allowed to override that constitutional return.
