Mississippi Criminalizes Abortion Pill Distribution Under New Drug Trafficking Law


Mississippi Governor Tate Reeves has signed House Bill 1613 into law, officially banning the prescription and distribution of abortion inducing drugs in the state. The law, which takes effect on July 1, 2026, amends the state's existing drug trafficking statutes to make it illegal to sell, prescribe, or distribute any substance intended to terminate a pregnancy.

Anyone found in violation of the new law faces a prison sentence of one to ten years. The Mississippi attorney general is also authorized to bring civil action against violators, which could result in injunctive relief and civil penalties.

The bill passed the Republican controlled State House of Representatives in a 77 to 39 vote and the State Senate in a 36 to 14 vote. While the vote largely divided along party lines, two House Democrats and three Senate Democrats crossed over to support the measure.

The continuing threat of mail order abortion pills being shipped into pro life states has been one of the most urgent challenges.

That statement came from Jeff Bradford, president of Human Coalition, who praised the legislation as a critical step in protecting unborn life.

The legislation specifically defines an "abortion inducing drug" as any medicine, drug, or substance prescribed or dispensed with the intent of terminating a clinically diagnosable pregnancy. It includes carve outs for the treatment of miscarriage, ectopic pregnancy, fetal demise, labor induction, and management of postpartum complications.

According to the Guttmacher Institute, approximately 91,000 women in abortion restricted states obtained abortion drugs in 2025, highlighting the scale of mail order abortion access that the new law aims to address. The Ethics and Public Policy Center has reported that 10.93% of women experienced adverse events from chemical abortions between 2017 and 2023, with a more recent analysis showing an 11.50% adverse event rate from July 2020 to December 2023.

State Rep. Celeste Hurst, a Republican from Sandhill, introduced the amendment that became the core of the legislation. She argued that the measure was necessary to prevent abortion medication such as mifepristone and misoprostol from being shipped into Mississippi through the mail.

Mississippi already had some of the nation's strongest abortion restrictions following the Supreme Court's Dobbs decision in 2022. This new law closes what pro life advocates call a dangerous loophole that allowed chemical abortions to circumvent existing state protections for the unborn.

Mississippi just showed the rest of America what real pro life leadership looks like. While other states drag their feet, Governor Reeves put his signature where it matters. The abortion industry thought they found a clever workaround with mail order pills, shipping death to doorsteps in brown envelopes like it was nothing more than a vitamin subscription. Mississippi said no. One to ten years in prison sends a clear message: you will not use the postal service to end innocent lives in our state. Every state that calls itself pro life should follow suit immediately.
