Kenya Just Reversed Abortion on Demand

Three Judge Bench in Malindi Overturns 2022 Pro Abortion Ruling as Kenyan Christians Celebrate Pro Life Victory


Kenya's Court of Appeal has issued a landmark ruling overturning the country's 2022 pro abortion expansion, declaring that pregnancy termination is not a constitutional right in Kenya. The decision, handed down by a three judge bench in Malindi on 3 May 2026, reverses a lower court ruling that had broadened abortion access.

The appellate court reaffirmed that Kenyan law, under Article 26(4) of the Constitution, restricts abortion to specific medical circumstances rather than recognising any general right.

Kenyan Christian Groups Celebrate Pro Life Court Victory

Under the restored constitutional standard, abortion is lawful in Kenya only when a trained health professional determines emergency treatment is necessary, the mother's life or health is in danger, or where written law specifically permits it.

The Kenya Christian Professionals Forum celebrated the decision as restoring constitutional order and reaffirming the right to life. Reproductive rights advocates warned the ruling could increase unsafe abortions, particularly in cases of rape or severe complications. Legal analysts expect the case to be appealed to Kenya's Supreme Court for a final determination on the scope of abortion rights in the country.

While Britain legalises abortion up to birth and Western elites push the abortion pill into every African pharmacy, Kenyan judges have just restored the right to life. Africa is increasingly the conscience of the global Church on life issues, even as the dechristianised West pours money and pressure into expanding the abortion industry there. Kenyan Christians have shown courage. Their Court of Appeal has shown integrity. Western pro lifers should be celebrating, learning, and supporting their African brothers and sisters as the next legal battle moves to the Kenyan Supreme Court.
