Federal Appeals Court Calls Biden FDA Mail Order Mifepristone Policy "Textbook Arbitrary and Capricious Agency Action"
The US Court of Appeals for the 5th Circuit has halted the Biden era FDA policy allowing mail order distribution of the abortion drug Mifepristone, a ruling that immediately blocks roughly 1,000 abortion drug shipments entering Louisiana every month.
The court called the Biden FDA's 2023 mail order policy "a textbook example of arbitrary and capricious agency action" and ordered restoration of in person dispensing requirements while Louisiana's challenge proceeds.
5th Circuit Restores In Person Dispensing for Mifepristone Abortion Drug
The case, State of Louisiana v. US Food and Drug Administration, was led by Louisiana Attorney General Liz Murrill and represented in part by Alliance Defending Freedom. ADF attorney Erin Hawley issued a stinging assessment: "The Biden FDA's unlawful authorisation of mail order abortion drugs was meant to nullify state laws that protect life."
The ruling, handed down on 5 May 2026, is a major pro life win that closes the loophole used to flood pro life states with chemical abortion. Mail order abortion pills had been used to circumvent state laws protecting unborn life by sending the drugs across state lines without any in person medical examination. The 5th Circuit has now slammed that door shut, at least temporarily.

The Biden FDA was caught red handed using its regulatory authority to nullify democratically enacted state pro life laws. The 5th Circuit named it for what it was: arbitrary and capricious lawlessness. Pro life Louisiana refused to bend, and the Court vindicated her. Every red state should now follow Louisiana's lead and challenge every blue state and federal mechanism designed to flood their territory with chemical abortion. Dobbs returned the question to the states. The states must now defend their answer.
