The three states sued the FDA and abortion pill manufacturer Danco Laboratories over changes that now allow mifepristone to be distributed by mail and prescribed via telehealth, bypassing in person dispensing requirements that were removed in 2023 under the Biden administration.
DOJ lawyers argued that the states lack legal standing to bring the case and that the litigation threatens to "short circuit" the FDA's ongoing safety review of the drug. The government asked the court to either pause or outright dismiss the case.

This marks the second time in two months the Trump DOJ has sought to shut down a pro life legal challenge to mifepristone access. In late January, the department made a similar request in a separate case, Louisiana v. FDA, which also challenges the mail order abortion pill policy.

The filing has intensified frustration among pro life advocates who feel the Trump administration has failed to follow through on campaign promises to protect the unborn. A Cygnal survey found that 32% of Republican primary voters reported decreased enthusiasm for midterm elections over the administration's handling of the issue.
Senator Josh Hawley of Missouri responded by introducing legislation on March 11 that would strip mifepristone of its FDA approval entirely and ban its use for pregnancy termination.
DOJ Dismisses Pro Life Legal Challenges to Mifepristone While FDA Safety Review Stalls

The FDA originally approved mifepristone in 2000 and placed it under a Risk Evaluation and Mitigation Strategy (REMS) safety system in 2011. The Obama administration weakened these requirements in 2016, and the Biden administration removed the in person dispensing requirement altogether in 2023.
In September 2025, the Department of Health and Human Services and FDA announced they would conduct a safety review of the drug. However, no timeline for completion has been provided, leaving pro life groups concerned the review is being used to indefinitely delay action.
The DOJ's legal strategy in these abortion pill cases mirrors the approach taken by the Biden administration, a fact that has not gone unnoticed by conservative critics.

Let's be clear about what just happened. The Trump administration, which rode into office on the votes of millions of pro life Christians, just told those very same voters to pound sand. They sided with the abortion pill industry over the states trying to protect unborn children. This is not some procedural technicality. This is the Department of Justice actively fighting to keep a drug on the market that has one purpose: ending the lives of innocent human beings. Every single day that mifepristone flows freely through the mail, children die. The administration promised to protect the unborn. Instead, they are shielding the very industry that profits from their deaths. If the DOJ will not act, then the Church must rise and demand it.
