Elon Musk's social media platform X has formally appealed a roughly $140 million fine imposed by the European Commission under the Digital Services Act (DSA), marking the first ever judicial challenge to a penalty issued under the controversial EU law.

The European Commission fined X €120 million in December 2025, citing three alleged violations: the "deceptive design" of its paid blue checkmark verification system (€45 million), insufficient transparency in the advertising repository (€35 million), and restrictions on researchers' access to public platform data (€40 million).

X's Global Government Affairs team filed three related cases at the Court of Justice of the European Union on February 16, 2026, involving X Internet Unlimited Company, X Holdings, and entities linked to Elon Musk.

In its filing, X's legal team called the EU decision the result of:

"An incomplete and superficial investigation, grave procedural errors, a tortured interpretation of the obligations under the DSA, and systematic breaches of rights of defence and basic due process requirements suggesting prosecutorial bias."

ADF International, a legal organization supporting X's challenge, framed the case as a critical test of how far Brussels can go in regulating content practices of major online platforms. Jeremy Tedesco of ADF International stated that X is being targeted "because X is committed to free speech."

The case carries global significance. U.S. Secretary of State Marco Rubio called the fine an attack on the American people by foreign governments. Vice President JD Vance previously criticized DSA enforcement as censorship. FCC Chairman Brendan Carr said it demonstrated bias against American technology firms.

If the General Court annuls or narrows the penalty, the ruling could reshape the Commission's enforcement strategy across the EU's entire digital rulebook. If the fine stands, it could strengthen Brussels' authority to press ahead with sweeping oversight of major technology platforms.

The DSA, adopted in 2022, grants the European Commission authority over content moderation practices on large platforms with more than 45 million monthly EU users. Free speech experts, European NGOs, the U.S. Administration, and the House Judiciary Committee have all criticized the law for imposing what they describe as an online censorship regime with global reach.

Musk himself called for the European Union to be abolished after the fine was issued, stating that sovereignty should be returned to individual countries "so that governments can better represent their people."
